These Terms & Conditions (“Terms”) govern access to and use of RealtyPesa, including its Android application, iOS application, website and web application (collectively, the “Platform”), operated by Shree Raghav Builders and Developers (GST No. 23EDFPM1276L1ZD) having its registered office at 42, Bajrang Nagar, Indore, Madhya Pradesh, 452010 (“Company”, “we”, “us”, or “our”).
By creating an account, accessing or using the Platform, you agree to these Terms and the applicable Privacy Policy.
If you do not agree, you must discontinue use of the Platform.
RealtyPesa is a technology-enabled real-estate and services platform intended to facilitate discovery, lead submission, lead management, business enquiry, transaction support and collaboration relating to legitimate property and service opportunities.
The Platform may facilitate opportunities relating to:
The Platform is not a gambling platform, lottery, betting service, gaming-for-money platform, investment platform, securities platform, chit fund, money-circulation scheme, or collective investment scheme.
The Platform does not require users to risk money or something of monetary value in order to obtain a business benefit.
The Platform may support:
Authorised personnel of the Company responsible for managing Platform operations, users, leads, properties, services, offers and related business processes.
An employee or authorised representative of the Company responsible for reviewing, validating, following up on and processing leads and assisting with legitimate business conversions.
An individual accepted by the Company to submit legitimate business leads and, where applicable, participate in the Company’s transaction-linked sales commission or incentive programme.
An Agent is not automatically an employee, partner, franchisee or legal representative of the Company unless expressly appointed under a separate agreement.
A user accessing the Platform for property or service discovery, enquiries, lead submission, communication or other permitted purposes.
Eligible users may apply to become Agents subject to the Company’s verification and acceptance process.
Agent registration:
The Company may verify identity, contact details, KYC information and other information reasonably required for legitimate business purposes and regulatory compliance.
Users and Agents may submit legitimate business leads through the Platform.
A lead may relate to:
Lead information may include text, photographs, documents, contact information, location, requirements and other relevant details.
A person submitting a lead represents that the information is accurate to the best of their knowledge and that they have the lawful authority or appropriate basis to provide any personal information contained in the lead.
The Company may reject duplicate, false, misleading, incomplete, fraudulent or previously recorded leads.
Submission of a lead does not constitute a confirmed transaction.
The Company may assign a lead to an authorised Sales Executive or other authorised personnel for verification and follow-up.
The Company may independently verify:
Only a transaction that satisfies the Company’s applicable eligibility and verification criteria may be treated as a Verified Transaction.
The Platform may display information concerning a user’s submitted leads and the status or conversion history of such leads.
Such information may include:
The conversion history is intended primarily to provide transparency regarding activity and business status.
A displayed lead or conversion status does not by itself constitute a guarantee that a commission or incentive is payable.
Subject to applicable eligibility criteria and a separate Company-approved commission or incentive framework, an Agent may be eligible to receive a sales commission, lead-generation commission, performance incentive, or similar business compensation in connection with a Verified Transaction.
Any such compensation:
The Company may determine applicable commission or incentive amounts internally based on factors including transaction category, transaction value, role performed, lead quality, business contribution, geography, commercial arrangements and other legitimate business considerations.
The Platform does not provide a digital wallet, points balance, token system, virtual currency, in-app cash balance, tradable credit or other digital representation of monetary value for Agent compensation.
Eligible sales commissions and incentives may be calculated, verified, approved and paid through the Company’s offline/internal business processes.
Such processes may include:
The Company’s internal records shall be used to determine whether a payment is due, subject to applicable agreements and law.
The Platform may provide referral-code functionality for attribution, onboarding, customer acquisition and business-source tracking.
A user may share their referral code with another person.
Where the Company has separately approved a one-level collaboration arrangement, an Agent who directly introduced another Agent may be recognised as an Introducing Agent, while the directly introduced Agent may be recognised as an Introduced Agent.
An Introducing Agent may be considered for a limited collaboration commission or incentive only where the Introduced Agent independently contributes to a qualifying Verified Transaction and the applicable commercial programme provides for such compensation.
No compensation is payable merely because:
No compensation is paid on transactions generated by persons beyond the directly introduced Agent.
Accordingly, the Platform does not operate an unlimited multi-level compensation or multi-generation commission structure.
The Company does not represent or guarantee that users can earn money by recruiting people.
The act of recruitment itself has no independent monetary value under the Platform.
Any eligible compensation is connected to genuine and verified business transactions and legitimate business contribution.
Users must not advertise the Platform using claims such as:
The Platform does not operate a points, tokens, coins, gaming credits, virtual currency or similar earning mechanism for Agent commissions.
Lead and conversion records displayed within the Platform are business records only.

Any commission or incentive is determined by legitimate business activity and applicable commercial criteria.
The Platform does not solicit investment from users.
No property listing, Agent registration, referral arrangement or business activity on the Platform constitutes an offer or promise of investment return.
The Company does not guarantee:
Property information displayed on the Platform may include:
Information may be obtained from property owners, developers, brokers, Agents, Company personnel, service providers or other sources.
The Company does not represent that every listing is complete, accurate, current, available or suitable for a particular transaction.
Users must independently conduct appropriate legal, title, financial, technical and other due diligence.
Where applicable, parties involved in property transactions remain responsible for compliance with RERA and other applicable real-estate laws.
The Platform may display or facilitate enquiries relating to third-party property owners, developers, brokers, contractors, architects, suppliers or service providers.
Unless expressly stated otherwise, the Company is not the seller, owner, landlord, tenant, developer, contractor, architect or service provider of every third-party offering displayed on the Platform.
Third-party transactions remain subject to the relevant parties’ own agreements and legal obligations.
The Platform may contain offers relating to goods or services published by the Company or third parties.
Each offer may be subject to separate conditions, availability, geography, validity period and exclusions.
The existence of an offer on the Platform does not constitute a guarantee of continuing availability.
Users may submit photographs, descriptions, documents, property information and other content.
Users are responsible for ensuring that such content is lawful, accurate and does not infringe third-party rights.
The Company may moderate, remove, restrict or refuse content that violates applicable law, these Terms, privacy rights, intellectual-property rights or Company standards.
Where users submit content or interact through Platform functionality, the Company may provide appropriate mechanisms for:

Users must not:
Processing of personal data is governed by the Company’s Privacy Policy.
The Privacy Policy explains the categories of data collected, purposes of processing, sharing, retention, deletion and applicable user rights.
Users are responsible for protecting account credentials and must notify the Company of suspected unauthorised access.
The Company may apply security measures and account restrictions where reasonably necessary.
The Company may suspend or terminate an account for fraud, misuse, security concerns, breach of these Terms, regulatory requirements or other legitimate business reasons.
Termination does not necessarily extinguish obligations or rights arising before termination.
The Platform, software, design, trademarks, logos, interfaces, databases and other Company intellectual property are owned by or licensed to the Company.
Users may not copy, modify, distribute or commercially exploit the Company’s intellectual property without permission.
Where a commission or incentive becomes payable, payment may be subject to:
Agents remain responsible for their own applicable tax obligations.
To the maximum extent permitted by law, the Company shall not be liable for indirect or consequential loss arising from third-party transactions, inaccurate third-party information, market changes, third-party conduct, transaction cancellation, business opportunity loss or circumstances beyond the Company’s reasonable control.
Nothing excludes liability that cannot lawfully be excluded.
To the extent permitted by law, users agree to indemnify the Company against claims, losses or liabilities resulting from their unlawful conduct, misleading content, fraudulent leads, misuse of the Platform, infringement of third-party rights or violation of these Terms.
The Company and users shall comply with applicable laws and regulations, including where applicable:
The Company may add, modify, suspend or discontinue Platform functionality where reasonably necessary for commercial, technical, legal, regulatory or security reasons.
The Company may update these Terms from time to time.
Material changes may be notified through the Platform or other appropriate channels.
These Terms shall be governed by the laws of India.
Subject to mandatory statutory rights, disputes shall be subject to the jurisdiction of the competent courts/tribunals at Indore, Madhya Pradesh , INDIA.

RealtyPesa is a real-estate and property-services lead-generation and transaction-support platform.
Agents may submit genuine business leads and may be considered for sales commission or performance-based business incentives relating to verified transactions, subject to applicable Company policies and verification.
The Platform does not provide:
Any eligible commission or incentive is administered through the Company’s documented internal/offline commercial process and is supported by transaction and business records.
