This Disclaimer applies to your access to and use of RealtyPesa, including its Android application, iOS application, website and web application (collectively, the "Platform"), operated by Shree Raghav Builders and Developers (GST No. 23EDFPM1276L1ZD), having its registered office at 42, Bajrang Nagar, Indore, Madhya Pradesh, 452010 ("Company", "we", "us", or "our").

By accessing or using the Platform, you acknowledge that you have read, understood and agree to this Disclaimer, in addition to our Terms & Conditions and Privacy Policy. If you do not agree, please discontinue use of the Platform.

1. General Information Only

The content available on the Platform — including property listings, project details, pricing, availability, material and service information, images, descriptions and any other information — is provided for general informational purposes only.

While we make reasonable efforts to keep information accurate and up to date, we make no representations or warranties of any kind, express or implied, regarding the completeness, accuracy, reliability, suitability, availability or timeliness of any information on the Platform.

2. No Real-Estate, Legal, Financial or Investment Advice

Nothing on the Platform constitutes real-estate, legal, financial, investment, tax or professional advice of any kind. Any information provided is not a substitute for independent professional consultation.

Users must independently verify property title, ownership, approvals, RERA registration, legal status, technical specifications, pricing and other material facts, and are strongly advised to consult qualified legal, financial or technical professionals before entering into any property, construction, material-purchase or service transaction.

3. Third-Party Listings and Content

Property listings, material/goods listings, service offerings and related content on the Platform may be submitted by property owners, developers, brokers, Agents, suppliers, service providers or other third parties.

  1. The Company is not the seller, owner, landlord, tenant, developer, contractor, architect, supplier or service provider of every listing displayed on the Platform, unless expressly stated otherwise.
  2. The Company does not independently verify, endorse, guarantee or assume responsibility for the accuracy, legality or quality of third-party listings, content or offerings.
  3. Any transaction arising from third-party content is strictly between the concerned parties and is subject to their own agreements and legal obligations.

4. No Guarantee of Transaction, Income or Returns

The Platform is a technology-enabled lead-generation and transaction-support platform. It is not an investment platform, and nothing on the Platform should be construed as a promise, guarantee or assurance of:

  1. property appreciation, rental yield or investment return;
  2. guaranteed sale, purchase, rental or conversion of any lead;
  3. commission, incentive, income or earnings of any amount; or
  4. employment, partnership or business relationship with the Company.

Any sales commission or performance incentive payable to Agents is strictly subject to the eligibility, verification and commercial terms described in our Terms & Conditions, and is never guaranteed.

5. Not a Gambling, Investment or MLM Scheme

The Platform does not operate, and must not be represented by any user or Agent as, a lottery, betting, gaming-for-money, chit fund, money-circulation scheme, multi-level-marketing (MLM) or pyramid scheme, or any collective investment scheme. No compensation is generated merely by installing the application, registering an account, recruiting another person, or through chance-based outcomes.

6. User-Generated and Uploaded Content

Photographs, descriptions, documents and other content uploaded by users, Agents or third parties are the sole responsibility of the person submitting them. The Company does not guarantee the accuracy, legality or ownership of such content, and disclaims liability for any loss arising from reliance on it.

7. Third-Party Links and Services

The Platform may contain links to third-party websites, applications or services that are not owned or controlled by the Company. We are not responsible for the content, accuracy, policies or practices of any third-party site or service, and inclusion of any link does not imply endorsement.

8. Regulatory Compliance

Users and other parties involved in property transactions remain independently responsible for compliance with RERA and other applicable real-estate, consumer-protection, tax and regulatory laws. The Platform's availability does not relieve any party of their independent legal obligations.

9. Limitation of Liability

To the maximum extent permitted by applicable law, the Company shall not be liable for any direct, indirect, incidental or consequential loss or damage arising from reliance on information available on the Platform, third-party listings or conduct, transaction cancellations, market fluctuations, technical errors or interruptions, or circumstances beyond the Company's reasonable control. Nothing in this Disclaimer excludes liability that cannot lawfully be excluded under Indian law.

10. Availability of the Platform

The Company does not guarantee that the Platform will be available, uninterrupted, error-free or secure at all times, and reserves the right to modify, suspend or discontinue any part of the Platform for technical, legal, regulatory or commercial reasons.

11. Changes to This Disclaimer

The Company may update this Disclaimer from time to time. Material changes will be notified through the Platform or other appropriate channels. Continued use of the Platform after such changes constitutes acceptance of the updated Disclaimer.

12. Governing Law

This Disclaimer shall be governed by the laws of India. Subject to mandatory statutory rights, disputes shall be subject to the jurisdiction of the competent courts/tribunals at Indore, Madhya Pradesh, India.
